Introduction
This document outlines the terms of our delivery commitment for all Goods and custom-printed Bespoke Goods ordered through the FastLabels website ("Our Site"). It forms part of our overall terms and should be read in conjunction with them.
This Delivery Policy is a supplementary document to our main Terms of Sale, which can be viewed here: https://www.fastlabels.co.uk/company/terms-conditions.html. All definitions specified in our Terms of Sale are applicable to this Delivery Policy.
This policy should also be read alongside our Returns Policy, available at: https://www.fastlabels.co.uk/company/returns-policy.html.
Please be aware that all delivery dates, times, and durations mentioned on Our Site or in our communications are estimates. The final estimated delivery date may be adjusted based on the time required for the artwork design and proof approval stages.
Our stated turnaround times are estimates based on working days (Monday to Friday, excluding public holidays). The turnaround period commences once your Order is paid for and, where applicable, you have provided email confirmation of your artwork proof to our team. To ensure the turnaround period begins on the next working day, Orders and proof approvals must be finalised by 12:00 AM. Any turnaround times quoted on Our Site or in marketing materials are indicative and not guaranteed unless we have provided you with a guarantee in writing. For orders containing multiple items, the longest turnaround time applicable to any single item will apply to the entire order.
1. Delivery
1.1. Following your final approval of the artwork proof, all Bespoke Goods purchased via Our Site are typically dispatched from our facility within 48 hours.
1.2. We are not liable for delays caused by factors beyond our reasonable control. Such factors include, but are not limited to, courier network delays, postal service issues, stock shortages, or equipment malfunctions.
1.3. Should such a delay occur, we will inform you as soon as possible and take reasonable steps to minimise the disruption, such as arranging an upgraded delivery service at our cost.
1.4. Notwithstanding the above estimates, our standard delivery commitment is to deliver all Goods and Bespoke Goods within 30 calendar days from the date of your Order Confirmation, unless a different timeframe is agreed upon or specified during the ordering process.
1.5. If no one is available at your address to accept the delivery and the items cannot be posted through your letterbox, our courier will leave a notification with instructions on how to arrange a redelivery or where you can collect your parcel.
1.6. If you do not collect the Goods and/or Bespoke Goods or arrange for their redelivery, We will attempt to contact you for further instructions. We reserve the right to charge you for any storage and subsequent redelivery costs. If, after our reasonable efforts, we are unable to contact you or arrange for a successful delivery or collection, We may terminate the Contract. In this event, you may receive a refund for standard Goods. For Bespoke Goods, no refund will be issued, and We may deduct a reasonable sum to compensate for the net costs we have incurred, as detailed in our Returns Policy.
1.7. In the unlikely event that We fail to deliver the Goods and/or Bespoke Goods within the required timeframe (30 calendar days of the Order Confirmation or as otherwise agreed), you, as a Consumer, have specific legal rights. You may treat the Contract as terminated immediately if any of the following conditions apply: a) We have refused to deliver the Goods and/or Bespoke Goods; b) In view of all relevant circumstances, delivery within the agreed time period was essential; or c) You informed Us at the time of ordering that delivery within the specified period was essential.
1.8. If you choose not to cancel under the provisions of Part 1.7, or if those specific circumstances do not apply, you have the right to specify a new, reasonable delivery deadline.
1.9. As a Consumer, you are entitled to cancel all or part of your Order, provided that separating the items would not significantly diminish their value. Any sums you have already paid for the cancelled Goods and/or Bespoke Goods, including their delivery, will be refunded to you. If any cancelled items are delivered to you, you must return them to Us. We will cover the cost of this return postage; please contact Us using the details in our Terms of Sale to receive a return label or to arrange a collection.
1.10. Responsibility for the Goods and/or Bespoke Goods passes to you once they have been delivered to the address you provided, or once you (or a carrier organised by you) collect them from Us.
1.11. We cannot be held responsible for late or non-delivery if such failure is a result of you not providing Us with necessary information within a reasonable time after We have requested it.
2. Other Important Terms
2.1. You may not transfer (assign) your rights and obligations under this Delivery Policy (and the Contract, where applicable) without Our express written permission.
2.2. This Delivery Policy is not intended to confer any benefit on any other person or third party, and no such person or party shall have the right to enforce any of its provisions.
2.3. If any provision of this Delivery Policy is found by a court or other relevant authority to be unlawful, invalid, or otherwise unenforceable, that provision shall be deemed severed from the remainder of the policy. The remaining provisions shall continue to be valid and enforceable.
2.4. Any failure or delay by Us in exercising Our rights under this Delivery Policy shall not constitute a waiver of that right. A waiver by Us of a breach of any provision shall not constitute a waiver of any subsequent breach of the same or any other provision.
3. Law and Jurisdiction
3.1. This Delivery Policy, and the entire relationship between you and Us (whether contractual or otherwise), is governed by and interpreted in accordance with English law.
3.2. If you are a Consumer, you will benefit from any mandatory legal provisions in your country of residence. Nothing in Part 3.1 affects or diminishes your statutory rights as a Consumer.
3.3. If you are a Consumer, any dispute, controversy, proceeding, or claim between you and Us related to this Delivery Policy or our relationship (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, based on your place of residency.
3.4. If you are a Business Customer, any dispute, controversy, proceeding, or claim between you and Us related to this Delivery Policy or our relationship (whether contractual or otherwise) shall be subject to the exclusive jurisdiction of the courts of England and Wales.
